Q: Does the Flowserve name need to be featured on our products and literature?
A: The Flowserve name must be the dominant name on all products, sales literature, maintenance and operation instructions, etc. The heritage name may be shown on the products, but must be in a less conspicuous size, etc. We are to eliminate the use of all logos other than Flowserve.
Q: What if our castings have the heritage name "cast-in" and no other place for the Flowserve name?
A: Use up inventories of existing castings and immediately move to change the cast-in name to Flowserve. You may "cast-in" the heritage name in small, less conspicuous position if you feel it is necessary from a market identifier standpoint. Flowserve must be identified on all present castings by using a name plate or stickers. These identifiers must be as permanent as possible. All associated paperwork must have Flowserve as the "header".
Q: Do I have to use the heritage name?
A: No, you can use Flowserve exclusively but the decision to do so must be approved.
Q: Does Flowserve have to be prominent on all products, literature, advertising, etc?
A: Yes. If we are privately labeling a product for a customer, then Flowserve can be shown in a more inconspicuous way or not at all, depending upon your private label agreement.
Q: Do I need to include a marking symbol when a trademark or service mark is repeated in an advertisement?
A: No. Generally, it is not necessary to mark every occurrence of a trademark in an advertisement or other promotional materials but, at a minimum, this identification should occur once in each piece of printed matter, either the first time the mark is used or with the most prominent use of the mark. When in doubt, err on the side of “over-marking.”
Q: How do I use trademarks online properly?
A: The guidelines for the use of trademarks online are generally the same as those for using trademarks in print.
Q: How do I use trademarks properly in press releases or articles?
A: If a trademark is acknowledged in the heading of an article or press release, it is not necessary to also acknowledge it within the body of the document. The trademark symbol need only appear in the first or most prominent mention of the mark.
Q: Must I use the ™ or ® symbol every time I use a trademark?
A: The ™ or ® symbol need only appear in the first or most prominent mention of the mark. Omission of the ™ or ® symbol does not invalidate or compromise your rights in a trademark. Its purpose is to alert the public to your ownership of the mark, and it is one of the primary ways to affirmatively protect a mark.
